An untimely protest by the incumbent contractor against the award of contract to a competitor was considered on its merits because of omission of a required Department of Labor wage determination from the RFP. Since the agency had prior knowledge of dates for the wage determination, contributed to delays, and made preaward arrangements for contract modifications, the contract awarded was different from the one solicited and should be resolicited.
