TheGeneral Counsel, Law Enforcement Assistance Administration, requested an opinion as to whether annual leave forfeited at the end of 1974, allegedly due to exigencies of public business but not scheduled in advance, may be restored to five employees. Though employees did not have actual notice of scheduling requirement and it was known in advance that leave would not be granted, scheduling is a nonwaivable statutory requirement. Failure to give actual notice was not administrative error since employees had constructive notice of scheduling requirement.
