The protester objected to the rejection of its bid as nonresponsive as a result of a statement contained in its cover letter. Although the failure of the bidder to have a city license to operate the ambulance service did not justify the rejection of the bid, the statement by the bidder conditioning the bid upon possession of the license rendered the bid nonresponsive. The allegation by the bidder that it was told by agency personnel to include the statement did not alter the responsiveness of the bid since the Government was not responsible for the negligence of an employee in the absence of specific statutory provision.
