Request for Rescission of Contract Due to Error by Telegraph Company in Transmission of Bid

The contractor requested rescission of a sales contract, alleging that the telegraph company had made a mistake in the transmission of its bid modification. The contracting officer should have been on notice of the possibility of an error prior to award since the telegraphic bid modification listed 38 items in ascending sequence except for the contested Item 12 which was listed between Item 111 and 113. The contract awarded for Item 12 may therefore be rescinded.
