A decision was requested concerning the proper grade to be used in computing retired pay for purposes of the Survivor Benefit Plan for a deceased rear admiral who was serving as an admiral. The officer was transferred to the temporary disability retired list (TDRL) and died before he could be confirmed on the retired list as an admiral. The member's retired pay while on the TDRL should be computed on the basis of an admiral's basic pay, and the Survivor Benefit Plan should be based on that computation.
