Exercise of Contract Options

Highlights

The protester objected to the failure of the agency to exercise the entire 100 percent option under its contract and to the award of part of the requirements on a sole-source basis to another company. Since the protest regarding the sole-source procurement was not filed within 10 days after the basis of the protest was known, it was untimely and not for consideration. The agency was not required by terms of the option clause to exercise the option either in part or in its entirety. Therefore, the decision to exercise only part of the option and to procure the rest of the requirements from other sources was not objectionable.
