A company protested a contract award under a small business set-aside, alleging that valid offers did not exist at the time of award and that the agency did not properly request best and final offers from all offerers. The question of whether the decision to award the contract was made before or after expiration of the offer is not significant, and the offerer may waive expiration of the acceptance period at its discretion. The awardee's second best and final offer was neither requested nor received by the agency; this allegation was not considered.
