Entitlement to Arrears of Retired Pay Due Deceased Member

Beatrice J. Hogan, wife of a deceased member, requested reconsideration of a settlement denying her claim for the arrears of retired pay due the member on the date of his death. The deceased member's first wife was entitled to the arrears of retired pay since she was designated as the deceased member's beneficiary on the appropriate forms filed with the Army, and no forms changing the designation of beneficiary had been filed prior to the member's death. The deceased member's second wife was not entitled to the arrears of pay but might become so entitled if the first wife failed to file a claim within 3 years after the member's death.
