Claim for Backpay by Teacher Employed by the Overseas Dependents Schools

A teacher employed by the Overseas Dependents Schools System submitted a claim for backpay and a claim alleging a delay in her step increase. Since the Court of Claims ruled that salaries were properly set under Public Law 86-91, the claim for backpay based upon allegedly improper implementation of that law was disallowed. Although there was no definite time limit for filing a request for reconsideration of a settlement certificate issued by the GAO Claims Division, a request received 9 years after the date of the settlement was not timely, and full legal review was not made. However, review of the facts related to an alleged improper delay of the employee's step increase indicated that the claim was without merit since the employee took excessive leave without pay.
