The protester objected to the contracting officer's decision to waive first article testing for the successful bidder. The agency's determination that the company's quality history, under different corporate names, justified the waiver was not disturbed in the absence of a clear showing of arbitrary or capricious action. The contention that the agency should have conducted a preaward survey of the awardee was considered a protest against an affirmative determination of the bidder's responsibility and was not considered in the absence of contentions of fraud or defective responsibility criteria.
