Foreign National's Claim for Overtime Compensation

A foreign national employee requested reconsideration of a settlement which disallowed his claim for overtime compensation for work performed in excess of 40 hours a week. A court of competent jurisdiction returned a determination of the claim on its merits which constituted an absolute bar to a subsequent action on the same claim.
