Highlights

The protester objected to the rejection of its bid as nonresponsive and to the acceptance of the awardee's bid as responsive. The agency properly rejected the protester's bid since neither the list of accessories contained in the bid nor the bidder's accompanying descriptive literature indicated that a required accessory would be furnished along with the machine offered by the bidder. The protest regarding the agency's determination that the awardee's bid was responsive was untimely and not for consideration since it was not filed within 5 days of notification of the basis for the protest. In addition, the record showed no basis to object to the agency's acceptance of products of a different composition than the brand name item specified.
