The protester objected to the award of a contract to a contractor who did not meet a definitive criteria of responsibility and requested termination of the contract for the convenience of the Government. While it was improper to make the award to the successful bidder, termination of the contract for convenience was not recommended since, at the time of the award, waiver of requirements such as those not met by the bidder was permitted in decisions later overruled subsequent to the award. In future procurements, however, such definitive criteria of responsibility requirements should be strictly enforced.
