Improper Determination of Nonresponsiveness

A company protested the agency's determination that it was nonresponsive because its bid bond was deficient. The protester's failure to submit the total bid bond amount required by the solicitation may be waived since the bond submitted was sufficient to cover the difference between the low bid and the next low bid. The protester's bid should not have been rejected as nonresponsive; the current contract should be terminated, and award should be made to the protester.
