Request for Waiver of Indebtedness

A military member appealed a determination that the claim of the United States against him for an erroneous payment of temprary lodging allowance was precluded from waiver. Since the erroneous payment was discovered administratively in December 1966 by the agency and the recoupment action was upheld by GAO in January 1968, the member's claim for waiver of the indebtedness was precluded from consideration since the date of the discovery occurred more than 3 years prior to the date of enactment of the public law creating those provisions.
