A federal employee appealed a settlement disallowing his claim for overtime pay in lieu of compensatory time and questioned the classification of his position. Questions concerning the classification of his position were not for review by GAO since the Civil Service Commission (CSC) had final authority on classification appeals. The employee's position had been determined by his agency and CSC to be exempt from the Fair Labor Standards Act. Under the discretionary authority of 5 U.S.C. 5543(a), agency policy provided compensatory time rather than pay for authorized overtime for employees above grade GS-10, step 10. Therefore, the employee was properly denied pay for the overtime performed.
