The protesters objected to the rejection of offers as nonresponsive and the award of a contract to another bidder under a grant. The protests were considered because the courts in which the matter was being litigated expressed an interest in GAO views. Rejection of the low bid under a grantee's solicitation as nonresponsive was not proper since the basis for determining responsiveness was not stated in the solicitation. The contract should be terminated and awarded to the low bidder.
