Pro Rata Reimbursement of Real Estate Expenses

An advance decision was requested with regard to an employee's claim for real estate expenses incurred in connection with the purchase of a residence and surrounding acreage incident to a permanent transfer of duty station. The legal fee was a standard fee having no relation to the size of the tract involved or the amount of the loan obtained so the employee was entitled to reimbursement of the total fee for legal services. The employee was also entitled to reimbursement of the total recording and appraisal fees and the title insurance charge since these were also standard fees. However, the employee was only entitled to a prorated amount of the survey fee.
