Adjustments of Absence Without Leave Charges

An employee requested review of a settlement denying his claim for restoration of annual leave charges in his leave and pay records and removal of two absent without leave charges. When there is a dispute as to the facts, GAO will accept the agency's statement of the facts in the absence of a preponderance of evidence to the contrary. Since there was a dispute as to the facts and the employee did not present such evidence, there was no entitlement to compensation for the leave without pay charges nor to restoration of annual leave.
