The second low bidder protested any award to the low bidder under a grant, contending that the low bidder did not include pertinent documentation with its bid and that rendered the bid nonresponsive. The bidders were not unreasonably misled as to what documentation should be submitted with regard to affirmative action requirements, and the fact that the low bidder may have filed its affirmative action plans elsewhere did not constitute an obligation under this solicitation. The agency should award the contract to the protester if it is otherwise responsive and responsible.
