Claim for Reimbursement of Attorney's Fees

An advance decision was requested regarding an employee's claim for reimbursement of attorney's fees incurred incident to the purchase of a residence at the new duty station upon which the employee assumed an existing mortgage. The charges for services which are advisory in nature were not reimbursable. The charge for examination and certification of the title search and survey was reimbursable only to the extent that it covered updating the title examination and survey from the date of the existing loan. The closing attendance fee was reimbursable only if it represented a charge for conducting the settlement.
