An employee requested reconsideration of a settlement which limited to 6 percent of the selling price his reimbursement for a real estatebroker's commission incurred when he sold his residence at his old duty station. The employee paid a 9 percent commission even though the Department of Housing and Urban Development (HUD) schedule of closing costs showed a prevailing rate of 6 percent. The employee was only entitled to reimbursement at the 6 percent rate shown in the schedule of closing costs which was the prevailing rate in the locality where the house was sold since the higher rate was not the prevailing nor the generally charged rate.
