The protester objected to the rejection of its low bid for failure to acknowledge an amendment incorporating the applicable Davis-Bacon wage determination in the solicitation. Failure to acknowledge the amendment rendered the bid nonresponsive, notwithstanding the protester's contention that wages in its region were greater than those found in the amendment, since the acceptance of the bid as submitted at the time of bid opening would not have resulted in a contract containing the statement of the appropriate minimum wage rates as required by law. The failure to acknowledge the amendment was not for waiver as a minor informality since the amendment affected the bid price.
