A firm requested reconsideration of a decision in which GAO held that the high bidder in a timber sale, who was rejected due to quota restrictions for 1974, could receive the award in 1975. The earlier decision was not erroneous in either fact or law. The contention that the quota restriction was still in effect at the time set for contract performance was rejected because the purchase did not occur on that date as no contract came into being merely by submission of the high bid. The fact that the protester's own good faith protest allowed the 1974 quota restriction to lapse did not provide a basis to reject its bid in 1975.
