Highlights

A company requested reformation of its purchase contract because of a bid error alleged after the award. The contracting officer was on constructive notice of error since the high bid was 2.32 times the next high bid, 1.84 times the market appraisal, and inconsistent with the general bidding pattern. Since he did not request verification, the contract may be reformed for a period prior to contract termination by the bidder.
