Protest Against Partial Determination of Nonresponsibility

The low bidder protested a partial determination of its nonresponsibility, requesting that the portion of the contract awarded to another bidder be terminated and awarded to the protester. The determination, based on a preaward survey, that the protester was nonresponsible for lack of a capacity to timely deliver a portion of the items procured was reasonable. Since the contracting officer acted reasonably in finding the protester partially nonresponsible, the protester's claim for bid preparation costs must be denied.
