Highlights

An employee requested reconsideration of a settlement disallowing her claim for overtime compensation, alleging that she was compelled to perform substantial amounts of overtime because her superiors assigned her an abnormal workload. Her claim was properly denied since she failed to show that the work was ordered or induced by an official who had the authority to order or approve overtime and that she failed or refused to do so. Although the Fair Labor Standards Act of 1938 had been amended to apply to Federal employees, professional employees were exempted from the application of the overtime provisions of the act.
