A company protested the agency's determination that it did not qualify as a regular dealer under the Walsh-Healey Act. Responsibility for determining whether a bidder is qualified under the Walsh-Healey Act rests with the agency, subject to review by the Secretary of Labor, and is not for consideration by GAO. However, award to another bidder should be withheld until the protester's intention concerning review of the ineligibility determination is ascertained.
