Adjustment of Compensatory Time and Annual Leave Accounts
Highlights
An employee requested reconsideration of the denial of his request for reinstatement of or compensation for 70 hours of annual leave and compensatory time which he claimed was wrongfully taken from him by applying retroactively and without notice a 1970 regulation requiring use of compensatory time prior to annual leave. Adjustment in the leave account prior to the effective date of that regulation was based on a previously effective regulation requiring use of compensatory time off within the leave year in which it was earned. Adjustment in the leave account based on the 1970 regulation resulted only in a reallocation of hours of leave between annual and compensatory time accounts without loss of any leave.
