GAO commented on a Department of Justice (DOJ) request for classified documents relating to the Manhattan Project, which was needed for litigation between the United States and the asbestos industry. GAO held that since it did not have the authority to review the documents and determine the classification, DOJ's request was referred to the Departments of Defense, Energy, and State who granted DOJ's request by reviewing and declassifying the documents and submitting them to DOJ for use in the litigation.
