My dear Mr. Administrator:
Reference is made to letter dated May 17, 1950, from the Deputy Administrator requesting that J. T. Blair and Annamarie Keppler Faigle, agent cashiers, be relieved of liability under the provisions of the act of August 1, 1947, 61 Stat. 720, for the physical loss of Government funds mailed to regional disbursing offices in the discharge of their official duties as employees of the Veterans Administration.
It appears from the record that J. T. Blair forwarded by official registered mail a package containing $136.15 in currency and coin and checks, including Government as well as personal funds, to the checks, totaling $82, representing Government funds, to the regional disbursing office at Columbus, Ohio, that the package was lost in June 1948. The record further shows that the checks in the amount of $82 have been duplicated and properly deposited reducing the actual loss to %136.35. It also appears that Annamarie Keppler Faigle forwarded funds in the amount of $44 consisting entirely of checks to the regional disbursing officer at Cleveland, Ohio; that said funds were lost in April and July 1946. It has been administratively determined that both losses occurred in the discharge of official duties and through no fault or negligence on the part of the said employees.
J. T. Blair and Annamarie Keppler Faigle appear to have complied with the administrative regulations in force and effect at the time of the losses, and considering the reported facts, this office concurs with the administrative finding that the losses occurred in the official discharge of their duties, without fault or negligence on their part. Accordingly, the conditions for allowance of relief under the act of August 1, 1947, 61 Stat. 720, having been satisfied, the agent cashiers will be relieved of responsibility for the loss of funds involved and appropriate adjustment will be made in the collection records of this office to reflect the relief so granted.
